General Terms and Conditions

§ 1 Basic Provisions

(1) The following terms and conditions apply to contracts concluded with us as the provider (NOX Cycles Austria GmbH) via the website www.noxcycles.com. Unless otherwise agreed, any terms and conditions you may use are expressly rejected.

(2) A consumer within the meaning of these terms and conditions is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is any natural or legal person or a legal partnership who acts in the exercise of their commercial or independent professional activity when entering into a legal transaction.

§ 2 Conclusion of the Contract

(1) The subject of the contract is the sale of goods.

(2) By placing a product on our website, we make a binding offer to conclude a contract for that item under the conditions specified in the product description.

(3) The contract is concluded through the online shopping cart system as follows: The products intended for purchase are placed in the "shopping cart." You can view and modify the contents of the shopping cart at any time. After clicking the “checkout” or “proceed to order” button and entering your personal data, as well as choosing payment and shipping options, a summary of the order will be displayed. If you choose an instant payment method (e.g., PayPal (Express/Plus/Checkout), Amazon Pay, Sofort, giropay), you will either be redirected to the order summary page or to the respective provider’s website. There, you make the necessary selections or input your data. You will then be shown the order overview again either on the provider’s website or after being redirected to our shop. Before submitting the order, you can review and change the data, or cancel the purchase.
By submitting the order via the appropriate button (“place order with obligation to pay,” “buy now,” or similar), you declare legally binding acceptance of the offer, and the contract is thereby concluded.

(4) Non-binding inquiries from your side will be followed by a binding offer in text form (e.g., via email), which you can accept within 5 days unless a different period is stated.

(5) Order processing and transmission of all contract-related information is carried out via email, some of which is automated. You must ensure the email address you provide is correct and that receipt of emails is not blocked by spam filters.

§ 3 Right of Retention, Retention of Title

(1) You may only exercise a right of retention if it pertains to claims from the same contractual relationship.

(2) The goods remain our property until full payment of the purchase price.

§ 4 Warranty

(1) Statutory warranty rights apply.

(2) As a consumer, please check the goods immediately upon delivery for completeness, obvious defects, and transport damage and report any complaints to us and the carrier as soon as possible. Failure to do so has no effect on your statutory claims.

(3) Any deviation from the objective requirements of the goods is only considered agreed upon if you were informed of it before placing the order and the deviation was expressly and separately agreed.

§ 5 Governing Law, Place of Performance, Jurisdiction

(1) German law applies. For consumers, this only applies if it does not deprive them of the protection afforded by mandatory provisions of the law of the country of habitual residence.

(2) Place of performance and jurisdiction is our registered office if you are not a consumer but a merchant, legal entity under public law, or public-law special fund. The same applies if you have no general jurisdiction in Germany or the EU, or your place of residence or habitual location is unknown at the time of action.

(3) The UN Convention on Contracts for the International Sale of Goods is expressly excluded.

3.1. Contract language is German.
3.2. The full contract text is not stored by us. Before submitting the order, the contract data can be printed or saved electronically. After the order is placed, the order data and legal information will be sent again by email.
3.3. For inquiries outside the online system, you will receive the complete contract data in a binding offer via email, which can be printed or saved.

Battery Warranty for BMZ E-Bike Batteries in Nox Cycles Austria GmbH E-Bikes

  1. BMZ Germany GmbH, located at Zeche Gustav 1, D-63791 Karlstein am Main, manufactures BMZ E-Bike batteries. Nox Cycles Austria GmbH, located at Gewerbegebiet Süd 3, 6262 Schlitters, Austria, manufactures E-Bikes. These terms and conditions apply exclusively to the warranty program for BMZ E-Bike batteries offered and sold by Nox Cycles Austria GmbH starting with model year 2025 (V10 battery). The warranty program only applies to new BMZ E-Bike batteries in new Nox Cycles Austria GmbH bikes; "retrofits" are not covered. These terms exclusively govern all services under the BMZ battery warranty.

  2. Acceptance of these warranty terms during registration on the website, along with registration of the E-Bike and battery, is a mandatory requirement to claim warranty services. If the customer does not explicitly agree to the terms, they are not entitled to claim warranty benefits. Furthermore, accepting the general terms and conditions of Nox Cycles Austria GmbH is also required. Customers unwilling to accept these cannot claim any benefits from this battery warranty. 
  3. The warranty is available to users (natural or legal persons) who have purchased a BMZ E-Bike battery in a Nox Cycles Austria GmbH E-Bike and registered for the warranty program. 
  4. The current data privacy policy can be found at: https://www.noxcycles.com/datenschutz-noxcycles, where details on collected data and how it's processed are explained. 
  5. These warranty terms apply only between Nox Cycles Austria GmbH and the registered user/customer. Third parties cannot derive any rights. The transfer of user/customer rights without prior written consent from Nox Cycles Austria GmbH is prohibited. 
  6. Nox Cycles Austria GmbH may transfer rights and obligations from the sales and warranty terms to third parties in accordance with applicable law. 
  7. Nox Cycles Austria GmbH reserves the right to use suitable service providers (e.g., shipping companies) to fulfill contractual obligations, while complying with data protection requirements. 
  8. If any clause in these warranty terms is invalid, the remaining clauses remain unaffected. 
  9. In case of legal disputes, Austrian law applies, excluding the UN Sales Convention. For consumer transactions within the EU, the law at the consumer’s residence may apply if mandatory consumer protection rules require it. 
  10. The exclusive place of jurisdiction for all disputes related to this contract and warranty is the competent court for 6262 Schlitters, Austria. For consumers, the court at their residence may also be competent due to EU law. 
  11. The European Commission provides a platform for online dispute resolution (ODR). Nox Cycles Austria GmbH is neither obligated nor willing to participate in dispute resolution before a consumer arbitration board. 
  12. Customers may only set off or withhold payments if their counterclaims are legally established or undisputed. 
  13. The place of performance is 6262 Schlitters, Gewerbegebiet Süd 3. 
  14. Nox Cycles Austria GmbH offers a “Lifetime Warranty” for BMZ E-Bike batteries used in Nox E-Bikes starting with model year 2025 with V10 batteries, specifically in the Nox Amplifier P2 and future RS motor upgrade models. This “lifetime” is defined as 10 years from the delivery date to the original owner (buyer) of the E-Bike and battery. 
  15. The warranty is non-transferable and applies only to the original buyer of the E-Bike. 
  16. An annual battery inspection is mandatory, to be performed by an authorized Nox Cycles Austria GmbH service partner. The battery's state of health (SOH) will be checked using a capacity tester. If capacity falls below 70% SOH, it qualifies as a warranty case. 
  17. To ensure smooth warranty processing, the user must provide all necessary documentation and fulfill their cooperation duties in full. 
  18. Warranty coverage requires registration of the E-Bike and battery within 90 days of purchase, via the warranty landing page. Required info includes: Buyer’s name and contact details - Frame number and battery serial number - Purchase date and dealer information - Delivery date to the user - Upload of the original invoice 
  19. The user must annually service the bike and battery via an authorized Nox Cycles service partner. The service must include: Battery condition check (cycles, capacity, efficiency), Inspection of electric systems (motor, controllers, wiring), Timely software updates, General safety check. All results must be documented in the service portal, with a timestamp from the authorized service partner. Actions taken by the service partner are attributed to the customer. 
  20. The user must store and use the battery properly, follow recommended maintenance intervals, and provide proof of proper annual servicing and the original invoice in the event of a warranty claim. 
  21. In a valid warranty case, the battery will be repaired or replaced (with an equivalent battery) at the discretion of the warrantor. Transport and incidental costs are not covered. 
  22. The warranty excludes: Improper use, Overvoltage, Use outside specified conditions (e.g., extreme temperatures), Unauthorized modifications. It also excludes: Accident damage, Neglect of storage and maintenance instructions, Repairs by unauthorized workshops void the warranty. 
  23. The warrantor is not liable for indirect or consequential damages, including loss of profit, unless caused intentionally. Personal injury is not covered. 
  24. The warranty ends if the bike is sold to a third party or if annual servicing is not performed by an authorized Nox Cycles Austria GmbH service partner. 
  25. Batteries returned at the end of their lifecycle will be recycled, per Article 10 of the EU Battery Regulation. Manufacturers and retailers must take back old batteries and ensure environmentally responsible recycling and recovery of valuable materials, with proper documentation. 
  26. Statutory warranty rights under Austrian civil law remain unaffected by this separate battery warranty. 
  27. Claims under this warranty must be made within one year from the legally defined start of the limitation period. 
  28. Any further claims for damages or expenses—regardless of the legal basis—are excluded. 
  29. Force majeure, labor disputes, natural disasters, transport blockades, and other events beyond Nox Cycles Austria GmbH’s control release the company from its warranty obligations. Until Nox Cycles Austria GmbH is in default or warranty service has definitively failed, the customer may not remedy the defect via third parties. The statutory warranty period does not restart due to a warranty repair or battery replacement. 
  30. All copyright-protected material may only be used privately and in connection with intended usage. 
  31. Nox Cycles Austria GmbH takes no responsibility for third-party content on its website.

Frame Lifetime Warranty

Warranty Terms for the Additional Contractual NOX CYCLES Manufacturer's Warranty

NOX CYCLES E-mountain bikes are quality products made from high-grade materials. All NOX CYCLES high-performance aluminum frames are carefully manufactured, undergo rigorous stress testing, and are subject to comprehensive quality control during production and before delivery. In addition to the statutory warranty, NOX CYCLES grants the registered first purchaser a 10-year manufacturer’s warranty against structural material and workmanship defects on the entire frame. The rights of the first purchaser under this warranty exist in addition to and independently of the legal warranty rights as the buyer of the product.

The geographical scope of this warranty includes the European Union, the EEA (European Economic Area) member states, and Switzerland.

A. REQUIREMENTS FOR CLAIMING THE WARRANTY

The additional contractual manufacturer’s warranty becomes valid on the date of purchase of the e-bike directly from NOX CYCLES or an authorized dealer. It applies exclusively to the first lawful owner who registers the bike with NOX CYCLES (www.noxcycles.com/service/garantie) within 90 days of purchase, thereby concluding the present manufacturer’s warranty. The warranty is non-transferable, meaning it expires on the day ownership of the bike changes. To make a claim under the warranty, the first lawful owner must be able to present the original proof of purchase in the event of damage.

B. ASSERTION AND EXECUTION OF WARRANTY SERVICES

To make a warranty claim, the bicycle must be brought fully assembled along with the original proof of purchase, including the purchase date and the listed frame number, to the NOX CYCLES authorized dealer where it was purchased or (in the case of a Click & Collect purchase) picked up. The point of contact for warranty services is always the dealer, who will carry out the initial damage assessment, report the issue to NOX CYCLES, and, if necessary, organize the packaging and shipping of the bike to NOX CYCLES. NOX CYCLES will handle further communication with the warranty holder until the bike can be returned to the dealer for handover.

In the case of a warranty claim, the defective frame will be repaired or replaced with a new one at NOX CYCLES’ expense and discretion. If the original frame is no longer available, NOX CYCLES will offer a comparable frame from a successor model. The labor costs for assembling the new frame into a complete bike, as well as the related shipping costs, will be covered by NOX CYCLES. However, NOX CYCLES does not guarantee that all components installed on the original bike will be compatible with the replacement frame. Incompatible components that need to be replaced—such as the battery, motor, fork, shock, or wheels—will be invoiced separately. The final decision regarding the eligibility and execution of a warranty claim lies solely with NOX CYCLES.

C. EXCLUSIONS

THIS WARRANTY DOES NOT APPLY TO:

  • Damage or malfunctions resulting from accidents or crash damage (see Crash Replacement Service)

  • Improper assembly or installation of components that were not originally intended for the bike or are incompatible with it

  • Improper handling or intentional damage, including use of the bike outside the specified ASTM category or exceeding the maximum permissible total weight

  • Damage to frame paint or graphics

  • Frames with altered, illegible, or removed serial numbers

Normal wear and tear of bearings integrated into the frame and all other bike components (e.g., suspension forks, shocks, wheels, derailleurs, etc.) is not covered by this warranty. However, original parts or components are generally covered by the warranty of the respective parts or component manufacturer and must be claimed (usually through the bicycle dealer where the bike was purchased) directly with that manufacturer.

E. JURISDICTION AGREEMENT

This warranty does not cover any travel, shipping, or other incidental costs incurred in transporting the NOX CYCLES bicycle to an authorized NOX CYCLES dealer. Such costs must be borne by the warranty holder. Further or other claims—especially those for compensation of damages not related directly to the bicycle—are excluded, unless liability is mandatorily prescribed by law. Warranty claims submitted in a country other than the one in which the purchase took place may be subject to reasonable fees or other limitations, which the warrantor may determine at their reasonable discretion.

E. JURISDICTION AGREEMENT

These warranty terms and the contract between the warrantor and the warranty holder (registered original purchaser) are exclusively governed by Austrian law, excluding the reference norms of Austrian international private law. All disputes, disagreements, and any claims arising from this warranty contract, or relating to the warranty contract, its formation, violation, termination, or invalidity, will be exclusively resolved before the court in Tirol, Austria, that is competent in terms of subject matter and jurisdiction for 6262 Schlitters.

Crash-Replacement-Service

Service Terms for the NOX Cycles Crash Replacement Service

NOX CYCLES bicycles are high-quality products made from premium materials. All NOX CYCLES frames are carefully crafted, undergo strict load testing, and are subject to comprehensive quality control both during production and before delivery. However, during intense use of an e-mountain bike—due to unusual stresses (e.g., during jumps) or in the case of falls and accidents—frame damage or even frame breaks may occur. For a one-time fee of 89.00 Euros, NOX CYCLES offers the registered original purchaser a Crash Replacement Service (CRS). The CRS applies to damage to the entire frame caused by an accident or fall, which impairs or makes the functionality of the bike impossible. In the case of CRS, the defective frame will be replaced with a new frame for a fee. If the original frame is no longer available, NOX CYCLES will replace the damaged frame with a comparable frame from a successor model. NOX CYCLES offers the new frame under the CRS at heavily discounted prices:

  • NOX HYBRID Hardtail (Aluminum): CRS Price: 720 Euros
  • NOX HYBRID Fully (Aluminum): CRS Price: 940 Euros
  • NOX Amplifier Fully (Aluminum): CRS Price: 1,200 Euros
  • NOX HELIUM Fully (Carbon Main Frame): CRS Price: 1,245 Euros
  • NOX EPIUM Fully (100% Carbon): CRS Price: 2,230 Euros

NOX CYCLES reserves the right to adjust these prices during the warranty period to reflect changing market conditions, significant changes in procurement prices, manufacturing costs, freight and delivery costs, or VAT changes. Customers will be informed in advance of any price changes. NOX CYCLES does not guarantee that all components installed on the original bike will be compatible with the replacement frame. Incompatible components that need to be replaced—such as the battery, motor, fork, shock, or wheels—will be invoiced separately at the NOX CYCLES list prices. Additionally, labor costs for assembling the new frame into a complete bike, as well as shipping costs, will be charged.

A. CONDITIONS FOR CLAIMING THE CRS

The CRS becomes valid from the date of purchase of the bike directly from NOX CYCLES or an authorized dealer. It applies only to the first legitimate owner who registers the bike with NOX CYCLES within 90 days of purchase (at www.noxcycles.com/service/garantie) and purchases the Crash Replacement Service for 89.00 Euros through the NOX online store. The CRS is non-transferable; that is, if the bike is transferred to a new owner, the warranty expires on the day of ownership transfer.

B. CLAIMING AND IMPLEMENTATION OF THE CRS

To claim the CRS, the bike must be fully assembled and brought, along with the original proof of purchase (with the purchase date and listed frame number) and the completed NOX Cycles Crash Replacement application, to the NOX CYCLES dealer where it was purchased or (in the case of Click & Collect) picked up. The point of contact for warranty services is always the dealer, who will perform the initial damage assessment, report the issue to NOX CYCLES, and, if necessary, organize the packaging and shipping of the bike to NOX CYCLES at the expense of the warranty holder. NOX CYCLES will handle further communication with the warranty holder until the bike can be returned to the dealer for handover. NOX CYCLES reserves the right to refuse this service in individual cases if it is determined that the damage was intentionally caused.

C. EXCLUSIONS

THIS SERVICE DOES NOT APPLY TO:

  • Improper assembly or installation of components that were not originally intended for the bike or are incompatible with it

  • Improper handling or intentional damage, including use of the bike outside the specified ASTM category or exceeding the maximum permissible total weight

  • Damage to frame paint or graphics

  • Frames with altered, illegible, or removed serial numbers

E. JURISDICTION AGREEMENT

These terms and the contract between NOX CYCLES and the registered original purchaser are exclusively governed by Austrian law, excluding the reference norms of Austrian international private law. All disputes, disagreements, and any claims arising from this service contract, or relating to the service contract, its formation, violation, termination, or invalidity, will be exclusively resolved before the court in Tirol, Austria, that is competent in terms of subject matter and jurisdiction for 6262 Schlitters.
