TERMS AND CONDITIONS OF PARTICIPATION "Christmas" competition
1. Scope of application
These conditions of participation govern participation in the Nox Cycles Christmas raffle. By participating in the competition, participants accept these conditions of participation.
The organiser of this competition is Nox Cycles Austria GmbH (hereinafter "Organiser"), e-mail: info@noxcycles.com. Nox Cycles Austria GmbH is also responsible for data protection and is the contact for questions regarding the competition.
2. Participation
Participation in the competition is free of charge for participants. An Instagram account is required to participate in the competition.
2.1 Participation is only possible within the period specified in the competition description (13 December 2023 to 7 January 2024).
2.2 All natural persons residing in Germany or Austria are eligible to participate, with the exception of the persons mentioned in § 2.4. Persons who are at least 18 years old are eligible to participate.
2.3 To take part in the competition, the person taking part must like the raffle post on Instagram, follow the Nox Cycles Instagram profile, comment on the post and tag two people in the comment who would also be happy to win the prize in the period from 13 December 2023 at 12:00 CET to 7 January 2024 at 23:59:59 CET. Sharing the post in the story increases the chance of winning.
2.4 Excluded from participation are
- Minors under the age of 18 and legally incompetent persons.
- The organiser reserves the right to exclude persons from participation who violate these terms and conditions of participation or who gain or seek to gain an advantage over other participants by unduly influencing or manipulating the competition. In such cases, the organiser may also subsequently exclude participants from the competition, withdraw prizes and reclaim them.
- Employees of Nox Cycles Austria GmbH, the BMZ Group and any subsidiaries and sister companies and their direct relatives are also excluded from participation in the competition.
3. Realisation of the competition
3.1 The winner will be selected at random from all participants in accordance with § 2.3 by means of a random draw. The draw will take place on 08 January 2024.
3.2 The prize cannot be exchanged, changed or paid out in cash. The prize is non-transferable. Legal recourse is excluded.
4. Prize processing
4.1 The winner will be notified electronically by direct message via Instagram. With regard to the prize, the participant notified in this way is obliged to inform the organiser within two weeks of the notification being sent whether he or she accepts the prize. If the organiser does not receive a corresponding message within this period, the possibility of accepting the prize expires and the organiser reserves the right to determine another participant and notify them accordingly.
4.2 The winner agrees that the full first name and surname may be published by the organiser for advertising purposes.
4.3 As part of the prize processing, the appropriate bicycle frame size for the winner will be determined. The organiser will in any case attempt, but cannot guarantee, to actually provide the right frame size for the winner as a prize (see § 3.2).
5. Premature termination, adjustment or modification of the competition
The organiser is entitled to terminate, adapt or modify the competition prematurely at any time without prior notice and without giving reasons if the proper execution of the competition cannot be guaranteed without appropriate measures for technical or legal reasons.
